Serving a Legal Notice in Pakistan
Different occasions arise when a person or entity needs to take legal action against another person or entity, including but not limited to a property dispute, bouncing of cheque, divorce, eviction, consumer complaint, etc. However, before initiating a legal proceeding against another individual or entity, it is important to inform the other party that you are going to initiate a legal proceeding against them. This is where you serve a legal notice on the other party.

What is a Legal Notice?
A legal notice is a formal written document that a person or entity sends to another as a warning regarding the grievances that the person or entity has against the other party. This is a way of both warning and giving the other party an opportunity to resolve the matter.

What are the essentials of a Legal Notice?
Not everyone can serve a legal notice in Pakistan. A legal notice in Lahore can be served by only the following three people:
1. The individual can serve it directly.
2. The individual can serve it through a lawyer.
3. The individual who has been issued a power of attorney can serve the legal notice.
There are certain essentials that need to be included in a legal notice, and without which a legal notice is incomplete. Your legal notice needs to have the following information:
• Name and address of the sender.
• Name and address of the receiver.
• Cause of action for the legal notice.

This is where it becomes important to hire a legal notice lawyer in Pakistan as a layman is not able to describe the cause of action well in the legal notice. A legal notice lawyer in Lahore will be able to draft a legal notice in an accurate way.

Is it mandatory to serve a Legal Notice in Pakistan?

Legal Notice under Section 80 of the Code of Civil Procedure, 1908
Generally, a legal notice is filed in civil cases, and not in criminal cases as the State institutes a criminal case, thus it does not require the serving of a legal notice.

However, if you want to serve a legal notice to the Government for initiating a civil suit, then it is pertinent to look into Section 80 of the Code of Civil Procedure, 1908. According to this section, a legal notice can be sent to the Government or public officer if one wants to initiate legal action against them for any act claimed to be done by such public officer during the course of his official duty until the expiration of two months. This allows the Secretary of State or the public officer an option to offer compensation to the other party without going to court.

Legal Notice under Section 138 of the Negotiable Instrument Act, 1881

It is mandatory to issue a legal notice in matters involving the bouncing of cheque under Section 138 of the Negotiable Instrument Act, 1881. According to this Section, it is mandatory to send a legal notice to the issuer of the cheque within thirty days from the date of cheque bounce.
